1. Acceptance of Terms
By accessing or using Outreach Camel’s WhatsApp outreach platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
Outreach Camel provides WhatsApp outreach services including: – Connecting and managing WhatsApp numbers via QR scan – Cloud-hosted sessions for running WhatsApp accounts – Automatic lead validation against WhatsApp – Warmup services for building number trust and reputation – Campaign sequencer for automated messaging workflows – Unified inbox for managing conversations – Analytics for campaign performance tracking
3. Account Registration
To use the Service, you must: – Create an account with accurate and complete information – Maintain the security of your account credentials – Promptly notify us of any unauthorized access – Be at least 18 years old or the age of majority in your jurisdiction
You are responsible for all activities that occur under your account.
4. Acceptable Use Policy
You agree to use the Service only for lawful purposes. You must NOT use the Service to: – Send unsolicited messages (spam) or messages without proper consent – Harass, abuse, threaten, or intimidate any person – Distribute malware, phishing content, or fraudulent schemes – Impersonate any person or entity – Violate any applicable laws, regulations, or third-party rights – Interfere with or disrupt the Service or its infrastructure – Attempt to gain unauthorized access to any systems or data – Send messages promoting illegal goods or services – Engage in any activity that violates WhatsApp’s policies
We reserve the right to suspend or terminate accounts that violate these policies without notice or refund.
5. Pricing and Payment
5.1 Pricing Structure
Outreach Camel operates on a per-number pricing model with volume discounts: – 1-25 numbers: $89 per number per month – 26-100 numbers: $79 per number per month – 101-500 numbers: $69 per number per month – 500+ numbers: Custom pricing
5.2 Billing
Fees are billed monthly in advance. You authorize us to charge your payment method on file for all applicable fees. Prices are subject to change with 30 days’ notice.
5.3 Refunds
Fees are non-refundable except where required by law. If your account is terminated for violation of these Terms, no refund will be provided.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to: – Scheduled maintenance (with advance notice when possible) – Emergency repairs or security updates – Factors beyond our control (third-party outages, natural disasters) – Actions by WhatsApp or telecommunications providers
7. WhatsApp Compliance
You acknowledge that: – WhatsApp may suspend or ban numbers for policy violations – We cannot guarantee that numbers will not be banned or restricted – You are responsible for ensuring your messaging practices comply with WhatsApp’s policies – Our warmup services reduce but do not eliminate the risk of account restrictions – Outreach Camel is not affiliated with WhatsApp Inc. or Meta Platforms, Inc.
8. Lead Data and Messaging
You represent that: – You have obtained necessary consents to contact the leads you upload – You will comply with applicable data protection laws (GDPR, CCPA, etc.) regarding your lead data – You will not upload sensitive personal data without appropriate safeguards – You are responsible for maintaining backups of your data – Outreach Camel acts as a data processor on your behalf for lead data
9. Intellectual Property
The Service, including its software, design, logos, and documentation, is owned by Outreach Camel and protected by intellectual property laws. You may not: – Copy, modify, or distribute the Service or its components – Reverse engineer or decompile any part of the Service – Remove any proprietary notices or labels – Use our trademarks without written permission
You retain ownership of your content, data, and contact lists uploaded to the Service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: – THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND – WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE – WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES – OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE PAST 12 MONTHS
We are not responsible for any losses resulting from WhatsApp account bans, message delivery failures, or third-party service interruptions.
11. Indemnification
You agree to indemnify and hold harmless Outreach Camel, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
Either party may terminate this agreement: – You may cancel your account at any time through your dashboard – We may suspend or terminate your account for violation of these Terms – We may discontinue the Service with 30 days’ notice
Upon termination, your right to use the Service ceases immediately. We may delete your data after 30 days unless required by law to retain it.
13. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the Service with at least 30 days’ notice. Continued use after changes take effect constitutes acceptance of the modified Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of [Jurisdiction], without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with [applicable arbitration rules], except that either party may seek injunctive relief in court for intellectual property violations.
15. General Provisions
